If you are charged with a misdemeanor and released, you will be given a court dates on which to appear.

In several of the counties in Northern Virginia, the prosecutor usually learns of the arresting officer's version of the facts and circumstance for the first time on the morning of your first court date. 

If you appear on your first court date with an attorney, your attorney will talk to the arresting officer and the prosecutor to learn what the arresting officer's observed and believed to have occurred that led to your arrest.  Through your attorney, the prosecutor will in turn listen to your observations and point of view. The prosecutor and your attorney may also have an opportunity to talk to witnesses at that time.

Upon considering the facts and circumstances, usually as the police officer seems them, the prosecutor may make a plea offer to the defense attorney.  You and your defense attorney will then discuss the facts again and the likely outcome of the case if you were to go to trial. Ultimately you must make the decision to plead guilty with a plea agreement, or proceed to trial.
